1. NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED OR RESTRICTED. The SweepstakesLovers.com "Win A Cell Phone" Sweepstakes (the “Promotion”) begins at 12:01:00 AM Eastern Time ("ET") on Tuesday, October 12, 2010 and ends at 11:59:59 PM PT on Friday, December 31, 2010 (“Promotion Period”).
2. ELIGIBILITY: The Promotion is open to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older at the time of entry. Void outside the 50 United States and the District of Columbia. Also void where prohibited or restricted by law, rule or regulation. All applicable federal, state and local laws and regulations apply.
3. HOW TO ENTER: LIMIT: One (1) entry per person/email address during the length of the Promotion Period. Subsequent entries from the same person and/or email address will be disqualified. Go to http://www.sweepstakeslovers.com/win-a-cell-phone/ (the "Website") and complete the entry form with your true and correct information in all required fields. Upon successful submission of your registration form, you will earn one (1) Sweepstakes entry.
By entering the Promotion, entrant gives the Sponsor the right to use, edit, or publish the entrant’s name, image or likeness without further compensation. for promotional, advertising and/or publicity purposes in any media, now or hereafter known throughout the world in perpetuity, without compensation or notice to, or further consent of, to the entrant to the extent permitted by law. Sponsor, its agents and its assigns are not responsible for misdirected, late, lost, delayed, inaccurate, damaged, garbled, incomplete, undelivered or stolen entries delayed or misdirected entries or any combination thereof, for whatever reason, for lost, interrupted or unavailable network, wireless service provider, cable, satellite, Internet Service Provider (ISP) or other connections, or for errors, omissions, interruptions, deletions, defects, phone transmissions or delayed transmissions or in operations or transmission of information, in each case whether arising by the way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines, or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise and any mechanical, electronic, network, computer, printing, typographical, human or other error relating to or in connection with the Promotion.
4. SWEEPSTAKES DRAWINGS AND PRIZES/ODDS: An electronic randomized drawing will be held on or about Saturday, January 1, 2011 by SweepstakesLovers to select one (1) Grand Prize winners from all eligible entries received. Odds of winning depend on the number of eligible entries received.
One (1) Grand Prizes: One (1) Samsung RugbyTM II Cell Phone. Samsung RugbyTM II device only. No service plan included. Device will be unactivated and activation is not required. Approximate Retail Value of the prize is $249.99. Total value of the prizes is $249.99.
5. PRIZE AWARDING: LIMIT: One (1) prize per person and/ or household. All Prizes will only be awarded upon potential winners’ verification and final approval by Sponsor. No prize substitution, cash equivalent of prizes, transfer or assignment of prize permitted, except by Sponsor in its sole discretion, due to prize unavailability for any reason, and only then for a prize of equal or greater value. All prize winners will receive prize notification via electronic mail and/or telephone call to the electronic mail address or telephone number they registered with and must confirm acceptance of their prize within ten (10) days of notification. If the potential winning entrant of prize cannot be contacted; is ineligible; fails to claim the prize; or if the potential winner otherwise fails to fully comply with these official rules, he/she will forfeit that prize and the prize will be awarded to an alternate potential winner. Once a potential winner has confirmed acceptance, potential winner will be sent via United States Postal Mail and/or overnight mail an Affidavit of Eligibility/Compliance & Publicity/Liability Release forms, and a W-9. Potential winners must complete, sign, notarize and return to SweepstakesLovers all required forms within ten (10) days. Each potential winner becomes the “Winner” only after receipt of all required forms and verification of eligibility by the judges and Sponsor. Prize winner grants Sponsor the right to use and publish winner's proper name and state of residence online in connection with the Promotion. Acceptance of a prize constitutes permission for Sponsor and its affiliates to take photographs and/or video of each prize winner, and use winner's name and likeness solely for advertising and promotional purposes as Sponsor so determines without notice or further compensation, except where prohibited by law. All decisions of the judges and Sponsor shall be binding and final. The Promotion Entities do not assume any responsibility for any disruption in the Sweepstakes caused by circumstance or other unforeseen events outside of the control of the Promotion Entities. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Sweepstakes materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control. In no event will more prizes be awarded than those listed in Rule # 4.
6. DISQUALIFICATION: Entrants found tampering with or abusing any aspect of this Promotion, as solely determined by the judges and Sponsor, will be disqualified from participating in the Promotion. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be in violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Promotion if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right, but not the obligation, to award the prizes at random from among the eligible, non-suspect entries received up to the time of the impairment.
7. LIABILITY & RELEASE: By participating in the Promotion, entrants agree to release and hold harmless the Promotion Entities and each of their respective owners, officers, directors, employees from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Promotion or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt of any prize. Entrant further agrees that in any cause of action, the Promotion Entities’ liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Promotion Entities be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
8. TAX INFORMATION: All applicable federal, state, local, and other taxes of prizes are the sole responsibility of the applicable winner.
